Demo / Free Download

A demo download is an audio watermarked (or tagged) version of an instrumental that is provided free for demonstration purposes only. If you are planning to record a song to one of our instrumentals and make it available online to the public (even if it's only for non-profitable use or stream on sites like YouTube, Soundcloud, Instagram, etc), a license must be purchased. The free download shall only be used for casual listening or to record a personal demonstration song to. Standard License

• THIS LICENSE AGREEMENT is made on ("Effective Date") by and between Licensee (hereinafter referred to as the "Licensee") also, if applicable, professionally known as Licensee, and Producer ("Songwriter"). (hereinafter referred to as the "Licensor"). Licensor warrants that it controls the mechanical rights in and to the copyrighted musical work entitled The Beat Title ("Composition") as of and prior to the date first written above. The Composition, including the music thereof, was composed by Producer ("Songwriter") managed under the Licensor. All licenses are non-refundable and non-transferable.
• Master Use: The Licensor hereby grants to Licensee a (STANDARD) license to record vocal synchronization to the Composition partly or in its entirety and substantially in its original form ("Master Recording").
• Mechanical Rights: The Licensor hereby grants to Licensee a non-exclusive license to use Master Recording in the reproduction, duplication, manufacture, and distribution of phonograph records, cassette tapes, compact disk, digital downloads, other miscellaneous audio and digital recordings, and any lifts and versions thereof (collectively, the "Recordings", and individually, a "Recordings") worldwide for up to the pressing or selling a total of Ten Thousand (10000) copies of such Recordings or any combination of such Recordings, condition upon the payment to the Licensor a sum of Twenty-nine Point Ninety-nine dollars ($29.99), receipt of which is confirmed. Additionally licensor shall be permitted to distribute Unlimited free internet downloads or streams for non-profit and non-commercial use. This license allows up to Fifty Thousand (50000) monetized audio streams to sites like (Spotify, Apple Music, Amazon Music, etc) but not eligible for monetization on YouTube.
• Content-ID: Licensee may not register or permit the registration of the Master Recording with any content identification system or service (for example without limitation, with YouTube's Content ID, whether directly or through a thirds party such as CDBaby or TuneCore). This is a non-exclusive license agreement, and the Composition may have been or may yet be licensed to third parties for their own use; if any licensed users of the Composition tried to register their derivative songs, the content identification system might improperly flag all other users of the Composition as infringing uses.
• Performance Rights: The Licensor here by grants to Licensee a non-exclusive license to use the Master Recording in Unlimited non-profit performances, shows, or concerts. Licensee may receive compensation from performances with this license.
• Synchronization Rights: The Licensor hereby grants limited synchronization rights for One (1) music video streamed online (Youtube, Vimeo, etc..) for up to 500000 non-monetized video streams on all total sites. A separate synchronization license will need to be purchased for distribution of video to Television, Film or Video game.
• Broadcast Rights: The Licensor hereby grants to Licensee broadcasting rights up to 2 Radio Stations.
• Credit: Licensee shall acknowledge the original authorship of the Composition appropriately and reasonably in all media and performance formats under the name "TCustomz" in writing where possible and vocally otherwise. e.g. "(prod. by TCustomz)"
• Consideration: In consideration for the rights granted under this agreement, Licensee shall pay to licensor the sum of $29.99 US dollars and other good and valuable consideration, payable to Producer Name receipt of which is hereby acknowledged. If the Licensee fails to account to the Licensor, timely complete the payments provided for hereunder, or perform its other obligations hereunder, including having insufficient bank balance, the licensor shall have the right to terminate License upon written notice to the Licensee. Such termination shall render the recording, manufacture and/or distribution of Recordings for which monies have not been paid subject to and actionable infringements under applicable law, including, without limitation, the United States Copyright Act, as amended.
• Indemnification: Accordingly, Licensee agrees to indemnify and hold Licensor harmless from and against any and all claims, losses, damages, costs, expenses, including, without limitation, reasonable attorney's fees, arising of or resulting from a claimed breach of any of Licensee's representations, warranties or agreements hereunder.
• Audio Samples: 3rd party sample clearance is the responsibility of the Licensee.
• Miscellaneous: This license is non-transferable and is limited to the Composition specified above, constitutes the entire agreement between the Licensor and the Licensee relating to the Composition, and shall be binding upon both the Licensor and the Licensee and their respective successors, assigns, and legal representatives.
• Governing Law: This License is governed by and shall be construed under the law of the WV, United States, without regard to the conflicts of laws principles thereof.
• Term: Executed by the Licensor and the Licensee, to be effective as for all purposes as of the Effective Date first mentioned above and shall terminate exactly fifty (50) years from this date.

Premium License

• Master Use: The Licensor hereby grants to Licensee a non-exclusive license (this "License") to record vocal synchronization to the Composition partly or in its entirety and substantially in its original form ("Master Recording")

This license allows up to Five Hundred Thousand (500000) monetized audio streams to sites like (Spotify, Apple Music, Amazon Music, etc) but not eligible for monetization on YouTube.
• Content-ID: Licensee may not register or permit the registration of the Master Recording with any content identification system or service (for example without limitation, with YouTube's Content ID, whether directly or through a thirds party such as CDBaby or TuneCore). • Mechanical Rights: The Licensor hereby grants to Licensee a non-exclusive license to use Master Recording in the reproduction, duplication, manufacture, and distribution of phonograph records, cassette tapes, compact disk, digital downloads, other miscellaneous audio and digital recordings, and any lifts and versions thereof (collectively, the "Recordings", and individually, a "Recordings") worldwide for up to the pressing or selling a total of Unlimited (Unlimited) copies of such Recordings or any combination of such Recordings, condition upon the payment to the Licensor a sum of Ninety-nine Point Ninety-nine dollars ($99.99), receipt of which is confirmed. Additionally licensor shall be permitted to distribute Unlimited free internet downloads or streams for non-profit and non-commercial use. This license allows up to Unlimited (Unlimited) monetized audio streams to sites like (Spotify, Apple Music, Amazon Music, etc) but not eligible for monetization on YouTube.

• Broadcast Rights: The Licensor hereby grants to Licensee a (UNLIMITED) license to broadcast or air the Master Recording in (Unlimited) amounts of radio stations.
• Credit: Licensee shall acknowledge the original authorship of the Composition appropriately and reasonably in all media and performance formats under the name "TCustomz" in writing where possible and vocally otherwise. e.g. "(prod. by TCustomz)"
• Consideration: In consideration for the rights granted under this agreement, Licensee shall pay to licensor the sum of $99.99 US dollars and other good and valuable consideration, payable to Producer Name, receipt of which is hereby acknowledged. If the Licensee fails to account to the Licensor, timely complete the payments provided for hereunder, or perform its other obligations hereunder, including having insufficient bank balance, the licensor shall have the right to terminate License upon written notice to the Licensee. Such termination shall render the recording, manufacture and/or distribution of Recordings for which monies have not been paid subject to and actionable infringements under applicable law, including, without limitation, the United States Copyright Act, as amended.

Exclusive Rights

By making an exclusive rights purchase, the buyer automatically becomes bound to and accepts the following terms and conditions of the License Agreement.

TERMS AND CONDITIONS:

• Exclusive rights grant the buyer full ownership of the instrumental.
• This license guarantees that TCustomz Productionz shall not re-sell or re-license this instrumental after exclusive rights have been purchased.
• The buyer receives a high quality untagged master 44.1 KHz 16 Bit WAV file as well as the individual trackouts (stem files). Upon payment confirmation, the buyer will be e-mailed the download link.
• Exclusive rights allow the buyer to use the beat unlimited commercial projects (demos, mixtapes, albums, EPs, etc.) with unlimited amount of sales.
• All beats used must be credited as follows: "produced by TCustomz" or "prod. by TCustomz".
• Using any TCustomz Productionz instrumental without giving proper production credit is NOT permitted.
• This license expressly FORBIDS resale or other distribution of TCustomz Productionz products in any form, either as they exist or any modification thereof. The buyer SHALL NOT sell, loan, rent, lease, assign, remix, or rearrange any of the products sold or their rights under TCustomz Productionz to another user (i.e. - record label, production company, or producer), or for use in any competitive product.
• The buyer is responsible for the clearance of any samples that were used to create any beats used from the TCustomz Productionz instrumental catalog.
• This document serves as the standing agreement between the buyer and TCustomz Productionz. In the event that someone buys exclusive rights to the beat you have licensed non-exclusively, your rights shall stand per your license agreement.
• Any usage not explicitly allowed by this license, including but not limited to any usage by an unlicensed individual or organization, will be prosecuted.

Sound Kits

By making a sound kits purchase, the buyer automatically becomes bound to and accepts the following terms and conditions of the License Agreement.

TERMS AND CONDITIONS:

• All sound kits are sold non-exclusively and all masters remain property of TCustomz Productionz.
• Purchasing a sound kit gains the buyer non-exclusive rights and TCustomz Productionz reserves the right to re-license the same sound kit.
• Upon payment confirmation, the buyer receives a digital download link via email.
• This license expressly FORBIDS resale or other distribution of TCustomz Productionz products in any form, either as they exist or any modification thereof. The buyer SHALL NOT sell, loan, rent, lease, assign, remix, or rearrange any of the products sold or their rights under TCustomz Productionz to another user (i.e. - record label, production company, or producer), or for use in any competitive product.
• Any usage not explicitly allowed by this license, including but not limited to any usage by an unlicensed individual or organization, will be prosecuted.
